The agreement
These Terms of Service (the “Terms”) are an agreement between you and Opentime Ventures LLC (“Supertime,” “we,” “us,” “our”). They govern the Supertime iPhone app, our website, and related services that link to these Terms (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Community Standards. Our Privacy Policy explains how we handle information; it is not part of this contract but we encourage you to read it.
Who can play
You must be at least 13 years old to use Supertime. If you are under the age of majority where you live, you may use the Service only with the consent of a parent or guardian who agrees to these Terms on your behalf. By using the Service, you represent that you meet these requirements and are not barred from using the Service under applicable law.
Your account
- You sign in with a one-time code sent to your phone number. Keep sign-in codes private — anyone with a valid code for your number can access your account.
- Provide accurate information and keep it current. Your display name and profile image must comply with our Community Standards.
- You are responsible for activity on your account. Tell us promptly at support@supertimeapp.com if you believe your account has been compromised.
- You can delete your account at any time — see Account & Data Requests.
The Service
Supertime provides daily games and social features such as friends, groups, chat, results and leaderboards. The lineup of games, features, scoring, streaks and rankings may change, be interrupted, or be discontinued at any time. We work hard to keep daily content flowing and your progress intact, but we do not guarantee that any particular game, score, streak, ranking or piece of content will be available or preserved.
Your content & conduct
You own the content you submit to Supertime — messages, reactions, images, display names and similar material (“User Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for technical purposes such as formatting and thumbnails), display and distribute your User Content solely as needed to operate, provide, improve and secure the Service. This license ends when your User Content is deleted from the Service, except where limited retention is described in our Privacy Policy.
You agree not to misuse the Service. Among other things, you will not:
- Break the law, infringe others' rights, or violate our Community Standards;
- Harass, threaten or abuse other players, or share content that is hateful, sexually explicit or harmful;
- Impersonate any person, misrepresent your affiliation, or share another person's private information;
- Cheat, exploit bugs, scrape, reverse engineer, or access the Service by automated means or through anything other than the app and interfaces we provide;
- Interfere with the operation or security of the Service.
We may review, moderate, remove or restrict User Content or accounts that we reasonably believe violate these Terms, and we provide in-app blocking and reporting tools. If you give us feedback or suggestions, we may use them without obligation to you.
Supertime's content
The Service — including the games, puzzles, artwork, software, design and trademarks, but excluding User Content — is owned by Opentime Ventures LLC or its licensors and is protected by intellectual-property law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app and Service for your own non-commercial enjoyment in accordance with these Terms. We reserve all rights not expressly granted.
App Store
The app is distributed through the Apple App Store, and Apple's standard Licensed Application End User License Agreement applies to the app copy you download. Apple has no obligation to provide maintenance or support for the app and is not responsible for the Service, these Terms, or any claims relating to them. Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you with respect to your license to the app.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT CONTENT — INCLUDING USER CONTENT — WILL BE ACCURATE OR APPROPRIATE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OPENTIME VENTURES LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL OR PROFITS, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM. THESE LIMITS DO NOT APPLY WHERE THEY ARE PROHIBITED BY LAW.
You agree to indemnify and hold us harmless from claims arising out of your User Content, your use of the Service, or your violation of these Terms, to the extent permitted by law.
Termination
You may stop using the Service or delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, if we reasonably believe termination is necessary to protect the Service or its players, or if we discontinue the Service. Sections of these Terms that by their nature should survive termination — including content licenses during retention, disclaimers, limitations of liability and dispute terms — survive.
Governing law & disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Before filing a claim, you agree to try to resolve the dispute informally by contacting support@supertimeapp.com — most concerns can be resolved this way. Claims that are not resolved informally must be brought in the state or federal courts located in Delaware, and you and we each consent to their jurisdiction. Either party may bring qualifying claims in small-claims court instead. To the extent permitted by law, claims may be brought only on an individual basis and not as part of a class or representative proceeding.
Changes
We may update these Terms as Supertime changes. If we make material changes, we will post the revised Terms here, update the effective date, and provide additional notice where required — for example in the app. Continuing to use the Service after changes take effect means you accept the revised Terms. If you do not agree, stop using the Service and delete your account.
